The Service operates on a credit-based system. Each AI processing task consumes a specified number of credits. Credits are non-refundable except where required by applicable law. We reserve the right to modify credit pricing and consumption rates with reasonable notice.
We offer various subscription plans with recurring credit allocations. By subscribing, you authorize us to charge your payment method on a recurring basis according to your selected billing cycle (monthly or annual). You may cancel your subscription at any time through your account settings; cancellation takes effect at the end of the current billing period.
Payments are processed through third-party payment processors (PayPal and Creem). We do not store your full payment card details. All payments are subject to the terms and policies of the respective payment processor.
You agree not to use the Service to:
NSFW (Not Safe For Work) and sexually explicit content is strictly prohibited on ImgKit. You may not use the Service to generate, upload, share, or distribute any content that:
This prohibition applies to all forms of content, including but not limited to images, text prompts, generated outputs, API requests, and any other material submitted to or produced through the Service.

We may implement automated content filtering and detection mechanisms to identify and block prohibited content. Attempting to circumvent such mechanisms is itself a violation of these Terms.
The Service, including its code, design, branding, and underlying technology, is owned by ImgKit and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our prior written consent.
You retain ownership of the content you upload to the Service. By uploading content, you grant us a limited, non-exclusive, royalty-free license to process that content solely for the purpose of providing the Service to you. We do not claim ownership of your uploaded content or generated outputs.
Subject to your compliance with these Terms and applicable laws, you own the AI-generated images and other outputs produced through the Service. However, due to the nature of AI generation, we cannot guarantee that generated outputs are free from third-party intellectual property claims. You are responsible for verifying that your use of generated outputs does not infringe upon the rights of others.
The Service may integrate with or link to third-party services (payment processors, AI model providers, analytics). We are not responsible for the content, policies, or practices of these third-party services. Your use of third-party services is subject to their respective terms and policies.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMGKIT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED OUTPUTS WILL MEET YOUR EXPECTATIONS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IMGKIT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless ImgKit and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your use of the Service, or your infringement of any third-party rights.
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitations of liability) shall survive.
These Terms shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Hong Kong.
Credits and subscription fees are generally non-refundable. If you believe you are entitled to a refund due to a billing error or service malfunction, please contact us within 14 days of the transaction. We will review refund requests on a case-by-case basis. Refunds, if granted, will be processed through the original payment method.
These Terms constitute the entire agreement between you and ImgKit regarding the Service. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
